NOTICE OF A PUBLIC HEARING

JAMESTOWN CHARTER TOWNSHIP PLANNING COMMISSION

TO:      CITIZENS AND RESIDENTS OF THE CHARTER TOWNSHIP OF JAMESTOWN, OTTAWA COUNTY, MICHIGAN.

PLEASE TAKE NOTICE that on Tuesday, April 16, 2024, at 7:00 p.m., local time, a public hearing will be held by the Planning Commission of the Charter Township of Jamestown, Ottawa County, Michigan, at the Jamestown Charter Township Hall, 2380 Riley Street, Hudsonville, Michigan, 49426, to hear and consider the Preliminary Planned Development Plan for the Heritage and the related map amendment (rezoning) to the Zoning Ordinance Map of the Charter Township of Jamestown.

Section 1

The proposed Preliminary Planned Development Plan and map amendment (rezoning) for The Heritage seeks to establish 37 duplex family residential units and one single-family residential unit, open space, storm water detention, private drives, and related infrastructure in the Planned Development Zoning District. The property is located on the west side of 24th Avenue, south of Riley Street, parcel number 70-18-16-200-041.

Section 2

Any person interested in this matter may appear at such hearing in person or by agent or attorney. The tentative map amendment may be examined by any person at the Jamestown Township Hall. Written comments concerning this matter may be filed prior to the hearing with the Jamestown Charter Township Clerk, Jamestown Charter Township Hall, 2380 Riley Street, Hudsonville, Michigan, 49426, (Phone 616-896-8376), between 9:00 a.m. and 5:00 p.m., Monday, Tuesday and Thursday.

NOTICE OF A PUBLIC HEARING
JAMESTOWN CHARTER TOWNSHIP PLANNING COMMISSION

TO:      CITIZENS AND RESIDENTS OF THE CHARTER TOWNSHIP OF JAMESTOWN, OTTAWA COUNTY, MICHIGAN.

PLEASE TAKE NOTICE that on Tuesday, April 16, 2024, at 7:00 p.m., local time, a public hearing will be held by the Planning Commission of the Charter Township of Jamestown, Ottawa County, Michigan, at the Jamestown Charter Township Hall, 2380 Riley Street, Hudsonville, Michigan, 49426, to hear and consider public comment on proposed text amendment changes in Sections 3.24 and 19.16 of the Zoning Ordinance of the Charter Township of Jamestown, each of which relate to bicycle path development.   The principal provisions of the proposed text amendments can be summarized as follows:

Section 3.24

  1. Planning Commission Discretion. The proposed text amendments would clarify that the Planning Commission has the discretionary authority to require or not to require bicycle path improvements for site plan developments.
  2. Bicycle Path Developments. In instances where the Planning Commission decides to require bicycle path improvements for a site plan development, the proposed text amendments provide that those requirements could include:
  3. Granting the Township easements for bicycle paths; and,
  4. If an existing bicycle path or other public amenities are located within one-half mile or less from a development’s frontage, constructing a bicycle path within the easements; or,
  5. If an existing bicycle path or other public amenities are not located within one-half mile from a development’s frontage, allowing the applicant to elect whether to construct bicycle paths within the easements or to make a financial contribution to the Township for bicycle path construction (i.e., a “payment in lieu”). The Planning Commission may make this election, if the applicant fails to do so.
  6. Payments In Lieu. In instances where an applicant or the Planning Commission selects the payment in lieu option, the proposed text amendments provide as follows:
  7. If, within not more than five years after the applicant has tendered the payment in lieu to the Township, a bicycle path external to the development is located within one-half mile or less from the development’s frontage, the Township may use the payment in lieu to either (i) construct a bicycle path within the easements granted by the applicant, or (ii) construct a bicycle path that extends the external bicycle path closer to the development’s frontage; or,
  8. If, within not more than five years after the applicant has tendered the payment in lieu to the Township, a bicycle path external to the development is not then located within one-half mile or less from the development’s frontage, the Township shall return the payment in lieu to the applicant, with interest.
  9. Other Bicycle Path Matters. Section 3.24 already contains other provisions related to the following bicycle path matters: factors to be considered by the Planning Commission; easement locations; bicycle path locations; documentation of final decision; construction standards; easement width; and, exemptions from Section 3.24. The proposed text amendments would not make substantive changes to these existing provisions, but would simplify and reorganize them, for clarity.

Section 19.16

The proposed text amendments in Section 19.16 are nearly identical to the proposed text amendments in Section 3.24, as summarized above. However, because Section 19.16 pertains to Planned Developments, which involve an initial review and recommendation by the Planning Commission, followed by a final decision by the Township Board, the proposed text amendments to Section 19.16 incorporate this two-step review and approval process.
