SPRING GROVE FARMS 6 STREET LIGHTING SPECIAL ASSESSMENT DISTRICT NO. 1

NOTICE OF PUBLIC HEARING AND FILING OF SPECIAL ASSESSMENT ROLL

NOTICE IS HEREBY GIVEN that the Charter Township of Jamestown, Ottawa County, Michigan, has approved or will approve a contract with DAJ DEVELOPMENT LLC (the “Developer”), whereby the Developer will acquire and cause to be installed streetlights within the Spring Grove Farms Phase 6 residential development located within the Charter Township of Jamestown (the “Improvements”).

The Developer has petitioned the Township to establish a special assessment district (the “District”) for each residential development and in accordance with Act 188 of the Public Acts of Michigan of 1954, as amended (“Act 188”), to assess the costs to operate the Improvements against properties located in the District and benefitted thereby.

The Township has determined to proceed with the Improvements, has approved preliminary plans and estimates of costs for the Improvements, and has tentatively determined a special assessment district, consisting of the following described land which is specially benefitted by the Improvements and against which a portion of the cost of the Improvements shall be specially assessed:

Description of Spring Grove Farms Phase 6: 15 lots within the real property legally described as:
Part of the SW 1/4, Section 3, and part of the SE 1/4, Section 4, T5N, R13W, Jamestown Charter Township, Ottawa County, Michigan, described as: BEGINNING at the SE corner of Section 4; thence N89°50’53″W 22.00 feet along the South line of the SE 1/4 of Section 4; thence N01°36’05″E 435.60 feet parallel with the East line of said SE 1/4; thence N89°50’53″W 200.00 feet; thence S01°36’05″W 435.60 feet; thence N89°50’53″W 1105.73 feet along the South line of said SE 1/4; thence N01°41’19″E 2142.58 feet along the West line of the E 1/2 of said SE 1/4; thence N89°20’54″E 1323.07 feet; thence S01°36’05″W 500.98 feet along the East line of said SE 1/4; thence N88°01’46″E 502.45 feet along the North line of the S 5/8 of the W 1/2 of the S 1/2 of Section 3 to the NW corner of Country Living Estates (Liber 42 of Plats, Pages 5-7); thence S01°29’19″W 1659.41 feet along the Westerly line of said plat and it’s extension; thence S87°58’27″W 505.75 feet along the South line of said SW 1/4 to the place of beginning. Also: Part of the SE 1/4, Section 4, T5N, R13W, Jamestown Charter Township, Ottawa County, Michigan, described as: BEGINNING at the E 1/4 corner of Section 4; thence S01°36’05″W 362.99 feet along the East line of said SE 1/4; thence S89°20’54″W 1324.87 feet; thence N01°41’19″E 379.55 feet along the West line of the E 1/2 of said SE 1/4; thence S89°56’10″E 1323.74 feet along the North line of said SE 1/4 to the place of beginning.

TAKE NOTICE that the Township Board of the Charter Township of Jamestown will hold a public hearing at a regular meeting of the Township Board on July 17, 2023, at 7:00 p.m., local time, or shortly thereafter, at the Jamestown Township Hall, 2380 Riley Street, within the Township, to hear and consider any objections to the proposed Improvements, the proposed special assessment district, and all other matters relating to said Improvements.

TAKE FURTHER NOTICE that preliminary plans and estimates of cost for the Improvements are on file with the Township Clerk for public examination.

NOTICE IS FURTHER GIVEN that the Township Supervisor of the Charter Township of Jamestown has made and certified a special assessment roll for the Special Assessment District, which roll sets forth the relative portion of part of the costs of the Improvements which are to be levied in the form of special assessments against each benefitted lot or parcel of land in the special assessment district.

TAKE FURTHER NOTICE THAT THE TOWNSHIP BOARD OF THE CHARTER TOWNSHIP OF JAMESTOWN WILL HOLD A PUBLIC HEARING ON JULY 17, 2023, AT 7:00 P.M., LOCAL TIME, OR SHORTLY THEREAFTER, AT THE TOWNSHIP HALL, 2380 RILEY STREET, HUDSONVILLE, MICHIGAN, TO REVIEW THE SPECIAL ASSESSMENT ROLL AND THE SPECIAL ASSESSMENT DISTRICT FOR THE IMPROVEMENTS AND TO HEAR AND CONSIDER ANY OBJECTIONS THERETO.

TAKE FURTHER NOTICE that the special assessment roll is on file with the Township Clerk at the Township Hall for public examination.

TAKE FURTHER NOTICE THAT AN OWNER OR A PARTY IN INTEREST IN A LOT OR PARCEL OF LAND SUBJECT TO A SPECIAL ASSESSMENT MAY FILE A WRITTEN APPEAL OF THE SPECIAL ASSESSMENT WITH THE MICHIGAN TAX TRIBUNAL WITHIN 30 DAYS AFTER THE DATE OF CONFIRMATION OF THE SPECIAL ASSESSMENT ROLL, BUT ONLY IF SAID OWNER OR PARTY IN INTEREST APPEARS AND PROTESTS THE SPECIAL ASSESSMENT AT THIS HEARING. An appearance may be made by an owner or a party in interest, or his or her agent, in person or, in the alternative, an appearance or protest can be filed with the Township by letter prior to the hearing, in which case a personal appearance at the hearing is not required.

This notice was authorized by the Township Board of the Charter Township of Jamestown.
